General Conditions of Sale - GTC

Reservation - Any reservation is accompanied by a written confirmation made to the customer by email and the payment of a deposit of 50% of the total amount of the stay, deductible from the total invoice on the day of departure. The payment of the deposit implies the acceptance of these general conditions of sale.
Length of stay - The customer will not be able to avail himself of any right to maintain in the premises.
Terms of Payment - Accepted methods of payment are:
• Credit card – VISA, MASTERCARD, EUROCARD, . The cardholder expressly gives permission to Niaouli Lodge to charge the amount of the deposit and/ or balance agreed in these terms of sale.
• Bank cheque – account domiciled in New Caledonia and held in XPF, cheque payable to Niaouli Lodge SARL.
In this case, the reservation is taken into account only with the credit of the check on the account of Sarl NL.
• Bank transfer in XPF - The payment of the deposit of 50% of the stay can be made by transfer to the bank account of Niaouli Lodge. The reservation will be considered firm only when the payment will be credited to the bank account of Niaouli Lodge SARL.
Modification of reservation - Any modification of reservation must be requested by email directly from Niaouli Lodge.

Cancellation conditions - Any cancellation must be notified in writing by email.
1. Cancellation on the initiative of the tenant: Any termination of this contract on the initiative of the tenant must be sent to the owner by email, the date of receipt by the owner being authentic.
a) In case of cancellation by the tenant more than 15 days from the day of arrival, the owner returns within 7 days of termination, the full amount of the deposit paid by the tenant. Net of transaction fees.
b) In case of cancellation by the tenant less than 15 days from the date of arrival, the owner retains the full amount of the deposit paid by the tenant.
c) If the cancellation occurs for the second time regardless of the cancellation period, the landlord retains the full amount of the deposit paid by the tenant.
2. If the tenant did not show up on the day stated on the contract, without notice to the landlord:
(a) this Agreement shall be deemed terminated,
b) the deposit remains with the owner,
(c) the landlord may dispose of the tenancy.
3. Owner Initiated Termination:
Before entering the premises:
In case of cancellation of this contract by the owner before entering the premises, for any reason whatsoever except in case of force majeure, he will return to the tenant the amount of the deposit received.
This return will be sent to the tenant by email.
After entering the premises:
When the cancellation of the contract by the owner occurs during the term of the rental, it must be duly justified (proven deterioration of the rented premises, complaints from the neighborhood, accommodation of additional person or clause(s) of this contract not respected…).
This cancellation sent by email, leads to the immediate departure of the tenant.
The owner reserves the right to keep the amount of the deposit paid.
4. Interruption of Stay
In case of early interruption of the stay by the tenant, and if the responsibility of the owner is not questioned, no refund will be made. The owner can demand the full amount of the stay.
5. Force Majeure Cancellation
If the tenant justifies serious reasons presenting the characters of force majeure (unforeseeable event, bad weather, natural disaster, inaccessibility) making it impossible to proceed with the rental, the contract is terminated automatically. The amount of the deposit paid by the tenant is returned to him.
If the cancellation by the owner is due to a case of force majeure (unforeseeable event, bad weather, natural disaster, inaccessibility, etc.) the owner cannot be held responsible, a solution will then be found by mutual agreement (dates postponed/refund)
6. Change of reservation.
Any modification of reservation (change of dates/ number of people) must be requested by email and will be subject to the agreement of the owner.
No change of dates will be accepted within 15 days of the original arrival date.
